Abstract

The present study deals with the right to health in Brazil, which has the constitutional charter as an initial parameter, in which health is everyone's right and a duty of the state, with universal and equal access to actions and services for its promotion, protection and recovery. It is believed that in the current scenario, in order to understand this right, it is necessary to visit and understand the concepts of health, State, law, all, from a perspective derived from the belief that led to the affirmation of this right in the Constitution, that is, a yearning Social. According to the literature used, there has always been a concern for social engagement, but this feeling has fragmented. From this point of view, we sought to understand the articulation of the concepts inserted in the first part of article 196 of the CF/88 and then relate them to current times, aiming to identify the cause of the social withdrawal of the past prior to the enactment of the CF/88. That said, it is considered that universality, linked to the concept of what is the whole, may be the cause for the existence of this distance, thus fragmenting the context of concepts as provided for in the constitutional text must also be observed under the influence of the information technologies to which society is currently exposed.
